No charges in slaying of agent

4 held only on immigration issues

NOGALES — Two weeks after the Border Patrol detained four men following the fatal shooting of agent Brian Terry near Rio Rico, none of the four apparent suspects has been charged in connection with the killing, defense attorneys say.

The fact that the detainees have yet to be charged in such a high-profile case — they now face only immigration violations — is not significant on its own, said Marc Miller, criminal law expert at the University of Arizona Rogers College of Law.

Their son died in the line of duty and he’s gone forever to them. Now a
liberal court system doesn’t think they can prosecute? Given the FBI is in
charge of this, what’s the chance Eric Holder is behind this (I know he’s DOJ
but one never knows)?

and not just the headline or only specific paragraphs. The investigation
isn’t over. The four may yet be charged with additional crimes.

and remain silent on this incident. Dear Brian & family, we Americans who
stand for justice apologize for the lack of justice the nation is affording

Let’s see - if “Joe Q Legal American Citizen” was merely WITH an individual
who committed murder, they would be charged and prosecuted for the crime
along with the individual who actually did it. How ridiculous is it that
these 4 aren’t being charged? We need to seal the borders and give our Border
Patrol agents the power to use force when they are threatened. No ifs, and,
or buts. Stop the politically correct nonsense! his is a slap in the face to
BP Agent Terry’s family and all Border Patrol agents.

No, they wouldn’t: it’s called the “FELONY murder rule”, not the “Happen to
be in the same neighborhood murder rule”. The government has to be able prove
in court that the perps were committing a felony together in order to charge
the non-killers with the murder, regardless of their citizenship.

No, we don’t: the BP have had that power all along, like any other LEOs.

If we really tried to SEAL the borders, the very people calling for it now
would be screaming so loudly about the costs that they could be heard on
 Pluto.

Seems criminals are the only ones who get justice, the victims and families
are hung out to dry. All 4 should be charged as accomplices since they were
with the fifth suspect. “Her client has no prior criminal history, Bowman
said, “so it’s a little bit unusual for an illegal re-entry case.”
Evidently Bowman doesn’t consider illegal aliens repeatedly entering the
country illegal as being .. well . . illegal. According to the British
Telegraph newspaper today “South American drug gangs funding al-Qaeda
terrorists” and still our government refuses to secure the borders.
