BISBEE — Tombstone’s mayor, city attorney, council members and city clerk will not have to attend Open Meeting Law training that had been ordered by the County Attorney’s Office as part of a list of resolution for Open Meeting Law violations.

During a summary judgment on Monday, Superior Court Judge James Conlogue found the City of Tombstone in violation of Open Meeting Law, but tossed out a lawsuit filed against Tombstone by the county attorney’s office after the town failed to comply with some of the proposed resolutions.

Judge Conlogue seems insensitive to the Open Meeting Laws and should undergo
the training himself. There are many slips on the part of council people in
the county and, unless the public is alert and informed, these infrations go
unchallenged. You’d think city attorney’s would know the law, but please
believe me, they don’t (or asleep or bored or…). This instance is not the
first and it won’t be the last with judges like Conlogue who brushes off the
intent: to allow the public to address the elected body (and not get hassled
or hussled out). I think we should circulate a petition to demand that
Conlogue attend this training, perhaps even sponsoring a countywide seminar
to which he’d attend. He needs the reminder: we, the citizen, pay the bills.
