SV override issue goes to court on Tuesday

SIERRA VISTA —  A lawsuit aimed at having the Sierra Vista school district override measure taken off the ballot will have a day in court this week.

Judge James Conlogue in Division Five will be hearing the case at 10 a.m. on Tuesday in Bisbee.

In the case, plaintiffs Anthony Wenc and Ron Murray allege the school district has failed to adopt and make public a budget for the 2009-2010 school year, and that it hasn’t provided a copy of such a budget to the state superintendent of schools. The document filed lists Cochise County Schools Superintendent Trudy Berry and the Sierra Vista school board as the defendants.



School officials argue it is not necessary or possible to approve a budget for 2009-2010, and say they have done what was legally required to pursue to override.

In the documents filed with the Cochise County Superior Court office in Sierra Vista on Sept. 26, Wenc and Murray requested a preliminary injunction be granted to keep the district’s override request off the ballot until a ruling is made on the lawsuit by a judge.

Early voting has already started, with the override on the ballot.

    " There has been much hand-wringing about this. The district has a team of lawyers that they consult before they are cleared to put the override forward for a vote. Do you think a couple of backwards nobodies (Wenc and Murray) have it right? Laughable. It'll be thrown out, not because the judges are "small town," but because it's a frivolous lawsuit. Get back to basics and use the huge savings toward for teachers in our classrooms (which has had a declining classroom ratio compared to state and national averages).     " A budget for 2009-2010 most certainly could have been developed. Other business enties develop budgets for multiple years. Just takes a little work and knowledge of how to build a budget. They know what this year's budget is, they know that the law provides for an annual increase in finding of 2% and they can project costs increases based on prior years. If they don't have a budget then how do they know that 9% will bring in enough extra funding?? SWAG?? How did the Super know that they would be short by a certain amount next year without one? "

    " There shouldn't be any question about procedures on the override. With the district planning this override for months, they should have had all the steps lined up and executed without question. The new Superintendent came in at the end of the process, unfortunately; I hope Humburg did her job adequately or Agenbroad's inherited another problem. The way the district mishandled notifying the public of the 7 day deadline to submit pro/con statements for the override's voter pamphlet, leaves me skeptical of both their ethics and professionalism. So, we'll see on Tuesday. "

After all, taxpayers paid for YOUR education. Also, the school district is correct. There is no way to build, let alone pass, a budget for 2009-2010.     " It is impossible to adopt a budget for the next school year this early in the game. The budget is based on this year's expenditures and what the state will fund out. When preparing the override a tax impact statement is done by a financial co which the district must provide an estimated revenue control limit. What does Mr. Wenc and Mr. Murray do for a living? "

Even if Mr. Wenc and Mr. Murray win their lawsuit, this monster will ride again another day. Remember how the last one got through? Even if it's voted on, and voted down, it will keep coming back like a bad case of something.... "
